The rental agreement should outline all the responsibilities of both the tenant, as well as the landlord.

Only fixed term rental agreements are available in Manitoba.

The security deposit (damage deposit) collected by the landlord cannot exceed 100% of the agreed upon monthly rent.

If no claim is made against a damage deposit the landlord must return it to the tenant within 28 days of the termination of a rental agreement.

In the event of the renewal of an existing lease, the landlord must present the tenant with a new lease at least 30 days prior to the termination of the existing lease. If this does not occur, the terms of the previous lease will be in affect for the duration of the second lease.

If a tenant does not move out by the end of an agreement, the lease may become month-to-month.

A landlord has the right to charge the original tenant a one time fee of $150.00 in the event of a sublet.

In the event of a late rent payment, the landlord may charge the tenant $10.00 for the first day and then $2.00 for each day thereafter, up to a maximum of $100.00.

A landlord must give the tenant 24 hours notice if the want to enter an apartment, but in the event of an emergency, they can enter with no notice.

A landlord may evict a tenant immediately if he or she is caught smoking in an apartment which forbids it.
